PLEASE READ THESE TERMS CAREFULLY. THEY CONTAIN AN ARBITRATION AGREEMENT AND A CLASS ACTION WAIVER (SECTION 12) THAT AFFECT YOUR LEGAL RIGHTS. THEY ALSO LIMIT OUR LIABILITY (SECTIONS 8–10).

These Terms of Service (the "Terms") are a legal agreement between you and Mixermedia Web Solutions ("we," "us," or "our"), the operator of garagedoorrepairpalmbayfl.com (the "Site"). By accessing or using the Site, or by calling a phone number displayed on it, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site.

1. What the Site is — Independent Advertising and Referral Service

1.1. Mixermedia Web Solutions is an advertising and marketing company. The Site is an independent advertising and referral service. It publishes general information about garage door services in and around Palm Bay, Florida, and displays a telephone number that connects callers to an independent, third-party garage door service provider (the "Provider").

1.2. We are not a garage door company. We do not perform, supervise, schedule, or guarantee any garage door repair, installation, inspection, or other service. We are not a contractor, and we do not hold a contractor's license. We do not employ, train, insure, or control the Provider or any technician.

1.3. We are paid by the Provider. The Provider compensates us for calls and customer inquiries generated through the Site. This is an advertising relationship. We are not the Provider's agent, partner, joint venturer, or employee, and the Provider is not ours.

1.4. The Provider is responsible for its own services. Any estimate, quote, appointment, warranty, work, pricing, payment, or dispute is solely between you and the Provider. We do not receive payments from homeowners and are not a party to any contract between you and the Provider.

1.5. Verify before you hire. You are responsible for independently verifying the Provider's identity, licensing, registration, insurance, bonding, qualifications, reviews, and pricing before engaging it. In Florida, contractor licensing can be checked through the Florida DBPR license search. We make no representation that the Provider holds any particular license, certification, or insurance.

1.6. Images and testimonials. Photographs and illustrations on the Site are stock images, illustrative renderings, or may feature actors or models; they do not necessarily depict the Provider, its staff, its vehicles, or actual work performed. Any reviews, ratings, or statements about services are general in nature unless clearly attributed.

1.7. Information is general. Articles, guides, prices, and tips on the Site are provided for general informational purposes only, may be out of date, and are not professional, engineering, safety, legal, or financial advice. Garage doors and springs can cause serious injury; always consult a qualified professional.

2. Phone calls

2.1. The phone number on the Site is a tracking number that routes to the Provider. Standard carrier charges may apply.

2.2. Calls may be recorded and monitored by the Provider and/or its call-tracking service. By calling, you consent to recording and monitoring as described in our Privacy Policy. If you do not consent, do not call, or say so at the start of the call.

2.3. We do not operate the phone line and are not responsible for whether a call is answered, call quality, wait times, what is said on the call, or any follow-up by the Provider.

2.4. The Site has no forms, no SMS program, and we do not place outbound marketing calls or texts. If you receive unwanted calls that you believe relate to the Site, contact us at legal@garagedoorrepairpalmbayfl.com.

3. Eligibility

You must be at least 18 years old and a resident of the United States to use the Site. The Site is not intended for use outside the United States.

4. Acceptable use

You agree not to: (a) use the Site for any unlawful purpose; (b) place fraudulent, automated, harassing, or test calls to the phone number, or otherwise interfere with call tracking; (c) scrape, crawl, copy, or harvest content or data from the Site other than through standard search-engine indexing; (d) interfere with the Site's security or operation, probe or test its vulnerabilities, or bypass access controls; (e) frame, mirror, or republish the Site; (f) use the Site to send spam or to collect information about others; (g) misrepresent your identity or affiliation. We may block or restrict access for any violation.

5. Intellectual property

The Site and its content — text, articles, graphics, logos, design, software, and the compilation of all of these — are owned by us or our licensors and are protected by United States and international copyright, trademark, and other laws. You may view and print pages for personal, non-commercial use only. Any other use, including copying articles to other websites, requires our prior written permission. Third-party names and marks (including the Provider's and the manufacturers mentioned in our content) belong to their owners and are used for identification only; no endorsement is implied.

Copyright complaints. If you believe content on the Site infringes your copyright, send a notice meeting the requirements of 17 U.S.C. § 512(c)(3) to legal@garagedoorrepairpalmbayfl.com with the subject "DMCA notice."

6. Third-party websites and services

The Site links to third-party websites (manufacturers, government agencies, the Provider, and others). We do not control and are not responsible for their content, accuracy, availability, or privacy practices. Links are provided for convenience and do not imply endorsement.

7. Advertising and compensation disclosure

In accordance with the Federal Trade Commission's guidance on endorsements and advertising, we disclose that the Provider pays us for calls and inquiries generated through the Site, and that the Site is an advertisement for the Provider's services. Our content about garage door services is created to generate those inquiries. We may also earn compensation from other advertising displayed on the Site.

8. Disclaimer of warranties

THE SITE, ITS CONTENT, AND THE REFERRAL TO THE PROVIDER ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OR ERROR-FREE OPERATION. WE MAKE NO WARRANTY OR REPRESENTATION ABOUT THE PROVIDER OR ITS SERVICES, INCLUDING THEIR QUALITY, SAFETY, TIMELINESS, PRICING, LICENSING, INSURANCE, OR LEGALITY, AND WE DO NOT WARRANT THAT THE PROVIDER WILL ANSWER, RESPOND, OR PERFORM. SOME STATES DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

9. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, MIXERMEDIA WEB SOLUTIONS AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR PROPERTY DAMAGE, OR FOR ANY PERSONAL INJURY, PROPERTY DAMAGE, DEFECTIVE OR INCOMPLETE WORK, OVERCHARGING, OR OTHER HARM ARISING FROM THE SERVICES, ACTS, OR OMISSIONS OF THE PROVIDER OR ANY OTHER THIRD PARTY, ARISING OUT OF OR RELATED TO THE SITE OR THESE TERMS, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). THESE LIMITS APPLY TO THE EXTENT PERMITTED BY APPLICABLE LAW AND DO NOT LIMIT LIABILITY THAT CANNOT BE LIMITED BY LAW.

10. Release and indemnification

10.1. Release. Because we are not a party to any dealing between you and the Provider, you release us from all claims, demands, and damages of every kind, known or unknown, arising out of or in any way connected with any dispute you have with the Provider or any other third party you contact through the Site.

10.2. Indemnification. You agree to defend, indemnify, and hold harmless Mixermedia Web Solutions and its owners, officers, employees, contractors, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your use of the Site, your violation of these Terms, your violation of any law or third-party right, or your dealings with the Provider.

11. Governing law

These Terms and any dispute arising out of or relating to the Site are governed by the laws of the State of Florida and applicable federal law, without regard to conflict-of-law rules. The Federal Arbitration Act governs Section 12.

12. Dispute resolution: binding arbitration and class action waiver

12.1. Informal resolution first. Before starting arbitration or a lawsuit, you agree to email legal@garagedoorrepairpalmbayfl.com with a description of the dispute and your contact information, and to try in good faith to resolve it with us for 30 days.

12.2. Binding arbitration. If not resolved, any dispute, claim, or controversy arising out of or relating to the Site, these Terms, the Privacy Policy, or your referral to the Provider shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules (available at www.adr.org), rather than in court, except that (a) either party may bring an individual claim in small claims court, and (b) either party may seek injunctive relief in court for infringement or misuse of intellectual property. The arbitrator will be a single neutral arbitrator; the arbitration will take place in Brevard County, Florida, or by video or telephone at your election; and the arbitrator may award the same individual relief a court could. The arbitrator's decision is final and may be entered as a judgment in any court. AAA filing fees for consumers are capped under the AAA Consumer Rules; if the arbitrator finds your claim is not frivolous, we will reimburse your filing fee.

12.3. Class action and jury waiver. YOU AND WE AGREE THAT EACH MAY BRING CLAIMS ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING, AND THAT BOTH WAIVE THE RIGHT TO A JURY TRIAL. The arbitrator may not consolidate claims of more than one person. If this class action waiver is found unenforceable as to a particular claim, that claim (and only that claim) shall proceed in court, in Brevard County, Florida, and shall be stayed pending arbitration of the remaining claims.

12.4. 30-day opt-out. You may opt out of this arbitration agreement by emailing legal@garagedoorrepairpalmbayfl.com within 30 days after you first use the Site, with the subject "Arbitration opt-out," your name, and a statement that you opt out. Opting out does not affect any other part of these Terms.

12.5. Venue if arbitration does not apply. Any dispute not subject to arbitration shall be brought exclusively in the state or federal courts located in Brevard County, Florida, and you consent to their personal jurisdiction.

12.6. Time limit. Any claim must be filed within one (1) year after it arises, or it is permanently barred, to the extent permitted by law.

13. Changes, termination, and availability

We may change these Terms at any time by posting the updated version with a new "Last updated" date; changes apply to use of the Site after posting. We may change, suspend, or discontinue the Site or any phone number at any time without notice. We may restrict or terminate your access for any reason, including violation of these Terms.

14. General

These Terms, with the Privacy Policy and Cookie & Tracking Policy, are the entire agreement between you and us about the Site. If any provision is held invalid, the remainder stays in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them to a successor. Headings are for convenience only. "Including" means "including without limitation." Notices to us must be sent by email to legal@garagedoorrepairpalmbayfl.com or by mail to the address below.
